In the circumstances that both party's on the call are both in NY, if i initiate a call and its being recorded and the other party asks if the call is being recorded are you obligated to tell them and if you say no but continue to record, would this recording still be court admissible?

This lawyer is definitely bias but not wrong re: net vs gross distribution. What they fail to realize that in Michael’s new book, he writes about emotional betrayal and things that definitely make you question and understand why he moved forward with the lawsuit besides the obvious, it’s the only way to dissolve a conservatorship. He had to file. The new book is actually inspirational and has some great advice. To me, he’s taking a stand for himself. No matter when he released the book, ppl are still going to figure out a way to blame it.

Exactly...I taught law and was an IP attorney in NYC. I went to a Law and Economics law school (Go George Mason!)! The biggest take away here is the RISK. The movie Industry pours billions of dollars into movies that we have or will never see. They take risks every day that may or may not pay off. So of course, they're ones that make this wheel turn. That's why they get the biggest payout! It's The same reason why your favorite band growing up probably entered into a non favorable contract for their first release and in some of them lost millions, but in the industry, they pour billions into trying to find the next big star. And they don't know who's gonna make it, and who's not gonna make it? So of course, they're going to try to hedge their bets. During discovery they learn not only did the movie not make a profit, according to Hollywood accounting practices - no Hollywood studio movie has ever made a profit ever. Weird. Also Sandra Bulloch wasn’t in the movie, legally a company Sandra Bulloch set up before shooting was in the movie - was in this movie. And sadly that company (of which she was the sole employee) also lost money which is why it paid no taxes either. Sports boosters, retired sports stars, agents and Hollywood. Suuuureee no one is lying.

There are no accountings in this conservatorship that was instituted in 2004!!! Not one single filing from 2004 up to date. The court itself, by statute is supposed to receive yearly accountings. This is a problem.

The order appointing conservator is available (signed 12/7/2004). On the same day, the court filed an order waiving a Guardian ad Litem. RED FLAG!!! At the age of 18, a Guardian ad Litem to help explain “conservatorship,” and to protect the interests and rights of Michael would have been appropriate. If you have the people seeking to be the conservators explain it to you, they can willed undue influence and explain to you the wrong thing. I'm interested to see the court transcripts of what the courts advised Oher of at this point.
